Terms & Conditions
Here you will find the general terms and conditions for services and partnerships with Tagading GmbH. Effective as of September 2025.
1. Scope of Application
These General Terms and Conditions (hereinafter "T&Cs") apply to all contracts, deliveries, and other services provided by Tagading GmbH (hereinafter "Contractor") to its clients (hereinafter "Client").
Deviating, conflicting, or supplementary T&Cs of the Client shall only become part of the contract if and to the extent that the Contractor has expressly agreed to their validity.
2. Subject of the Contract and Services
The subject of the contract is the service specified in the respective offer or contract, in particular the development of complementary software solutions, strategic IT consulting, and associated maintenance and subscription services ("Sorgenfrei Partnership").
The exact scope of services, milestones, and remuneration are detailed in the individually agreed project contract or offer.
3. Client's Duty to Cooperate
The Client shall support the Contractor in the performance of the contractually owed services. This includes, in particular, the timely provision of necessary information, data materials, as well as hardware and software environments, insofar as this is necessary for the provision of the service.

4. Remuneration and Payment Terms
Remuneration is based on the agreements made in the respective offer (e.g., fixed price, time and materials, or monthly subscription). All prices are exclusive of the applicable statutory value-added tax (VAT).

5. Liability and Warranty
The Contractor is liable in accordance with statutory provisions for damages resulting from injury to life, body, or health caused by negligent or intentional breach of duty.

6. Final Provisions
The law of the Republic of Austria shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Graz, Austria.
